Terms and Conditions for IT-Legends services

Please read the following terms and conditions carefully before ordering services from us.
By signing an order form with IT-Legends you agree to be bound by these terms and conditions.
An order is deemed to be confirmed after the payment has been made.

We suggest that you print a copy of these terms and conditions for your reference.

1) Definitions
  1.1 The term 'agreement' is defined with respect to these Terms and Conditions, the Order Form,   and the Payment Schedule.
  Please note that the Payment Schedule and the Order Form (repectively) will prevail in the event of   any conflict of this agreement.
  1.2 The 'Customer' or 'Client' shall mean the company, it's employees or agents, representatives   and subcontractors to whom our services are provided as stated on the Order Form.
  1.3 'Fees' means the amount payable by the Customer for Services provided by IT-Legends as   stated on the Order Form.
  1.4 The length of 'term' shall mean one year from the Commencement date, unless stated   otherwise on the Order Form.
  1.5 The 'Order Form' shall be the agreed schedule between the Customer and the services   provided that form part of these Terms and Conditions.
  1.6 The 'Payment Schedule' means the agreed schedule of payments that will be made by the   Customer to IT-Legends for the agreed Services Provided.
  1.7 The 'Services' shall mean the services to be provided by IT-Legends as specified on the Order   Form and further described on our website www.it-legends.com
  1.8 The 'start date' or 'Commencement date' shall mean the beginning of any Services provided by   IT-Legends as noted on the Order Form.

2) Conditions
IT Legends will only carry out services after an agreement has been provided on an official order form and after payment has been made by the customer. Quotations made by IT-Legends will be valid for 7 (seven) days. All customers must be 18 (eighteen) years of age or older.

3) Clients obligations
The customer will allow IT-Legends reasonable direct and remote access to its website.
In order that IT-Legends can comply with the agreement, when necessary the customer shall also provide details such as, but not limited to, source code and diagnostic information.
The customer shall not disrupt the service provided by IT-Legends, and should comply with advice and directions given by IT-Legends within a reasonable period of time.

4) Payments
Payment is required in full before we can process your order and can be made by Cheque, online Paypal, Credit/Debit Card or Bank Transfer.
Payments may also be made through our 'easy payment plan' (details are available on the website) however it should be noted that once a payment has been made, NO refunds can be given.

5) Guarantees
  Link Building
  5.1)* IT-Legends shall provide the number of links as stated on the order form, and upon   completion, the link building report will be generated and forwarded to the customer. IT-Legends   offer no guarantee as to the length of time that the link stays live after the link report has been   completed.
  Website Development
  5.2)* IT-Legends will not be held responsible for delays of information and/or content material as   required for website development. The customer shall supply the necessary material as stated in   the order form, and the projected finish date will begin from the point at which the client submits   the required material.
  5.3)* IT-Legends websites are supported by the following browsers; internet explorer 7 and 6,   firefox 3 and 2, and the current versions of safari, opera and chrome. It should be noted that other   browsers may not fully interpret some images used in the website creation.
  5.4)* The agreed payment for website development relates to the specified work as noted on the   order form. Extra work required outside of this specification will require additional costs to the   customer as quoted at the time of development.

6) Data Protection Act
IT-Legends will not rent, sell, share or trade any of the personal or private information that is provided to us by the customer. All such information shall be kept in the strictest confidence and will be used in accordance with the Data Protection Act 1998.

IT-Legends shall:
  6.1 process personal data and information as agreed by the customer.
  6.2 process personal data and information as is necessary to provide the services as agreed in   the order form.
  6.3 use appropriate measures to protect the data and information against unauthorised or   unlawful processing.
  6.4 provide reasonable measures to ensure the confidentiality and reliability of any such data and   information as used by employee's of IT-Legends.

7) Liabilities and Exclusions
IT-Legends shall not be liable to any loss of profits, loss of business, goodwill or any similar losses, direct or consequential, loss, costs or damages.
It-Legends is not affiliated with any search engine network or directory, and any third party logo's or images used on this website remain the copyright of the respective companies.
IT-Legends will not be held responsible for delays or failure of performance caused by ISP delivery problems or failure, including but not limited to, hosting delays, acts of God, War, Earthquakes, power failures or other damages.
IT-Legends cannot guarantee against conditions that exist on the internet that are outside our control, such as breach of security and piracy. You hereby waive claim against IT-Legends for loss of data due to corruption, piracy or breach of security.
IT-Legends cannot be held responsible for dropping or exclusion of a URL by a search engine. Customers should be aware that search engine page ranking and listing results can go up and down.
IT-Legends will not be responsible for costs incurred and/or adverse search engine rankings as a result of SEO work that overwrites work carried out by IT-Legends, including but not limited to, uploads and changes made by the customer's webmaster.
IT-Legends will not accept orders which are deemed unsuitable, including but not limited to, illegal, offensive or pornographic material.
The customer hereby agrees that IT-Legends may refer to their name, company name and/or trading name for the purpose of marketing and promotion of our services.

8) Waivers
A waiver of contract will not be valid inless authorised in writing and signed/agreed by a director of IT-Legends.

9) Termination of services
IT-Legends may suspend the services or terminate the agreement if the customer:
  9.1 fails to pay any sum of money due as agreed in the order form.
  9.2 ceases business or becomes insolvent.
  9.3 fails to fulfill any of the obligations as noted in the agreement.
  9.4 interfere's with or disrupts the ability for IT-Legends to complete the services as agreed.

Complaints procedure
IT-Legends treat all complaints very seriously. In the unlikely event of a complaint, please submit an e-mail outlining the grounds for the complaint, using our contact us form.
